Background material for Government meeting

The following issues are scheduled for discussion at the Government meeting on November 23, 2012.

1. Transport System Development draft state programme

 The programme was prepared in line with Russia's long-term socio-economic development concept up to 2020, Russia's transport strategy up to 2030, Russia's railway transport development strategy up to 2030, Russia's airport network development concept up to 2020, and Russia's inland waterway management reform concept.

The programme includes the following sub-programmes: Mainline Railway Transport; Road Facilities; Civil Aviation and Air Navigation Services; Sea and River Transport; Transport Oversight; High-Speed Automobile Road Development with the Assistance of Public-Private Partnerships; and, Transport Logistics at the 2014 Olympic Games and the 2013 Twenty-Seventh World University Summer Games in Kazan and the Implementation of the State Programme.

 

2. Aviation Industry Development draft state programme

 The achievement of the tasks listed in the programme will create a qualitatively new and innovative image for the aircraft building industry.

The programme includes the following sub-programmes: Aircraft Building; Helicopter Building; Aero-Engine Building; Power-Plant Building; Instrument-Making; Light Aircraft Development; and, Aviation Science and Technology.

 

3. Draft federal law On Amending Articles 78 and 781 of the Budget Code of the Russian Federation in the Section Concerning Grants

 The draft law proposes adding to Articles 78 and 781 of the Budget Code provisions on issuing grants as subsidies to legal entities with the exception of state (municipal) institutions and to non-profit organisations that are not public institutions.

As tenders to obtain grants are open to budgeted and autonomous institutions under the jurisdiction not only of the tender administrator but also of other government authorities(local government bodies) – the amendments proposed by the draft to Article 781 of the Budget Code provide for federal executive authorities, regional executive authorities and local authorities, following tenders, to issue grants as subsidies to budgeted and autonomous institutions despite their 

 The draft law also proposes that the procedure for granting the above-mentioned subsidies from the federal budget, the budgets of constituent entities, and the local budgets be set according to the regulatory acts of the Government or of the supreme executive body of state authority in the entity concerned, or the municipal legal acts of the local administration unless the procedure is specified by a decision to issue the grant.

 

4. Draft federal law On Amending Article 131 of the Criminal Procedure Code of the Russian Federation

 The draft law proposes amending Clause 6 of Part Two of Article 131 of the Criminal Procedure Code to qualify the costs of transporting material evidence, or of transporting corpses or their parts, as procedural costs.

 The draft also proposes that the size of the monthly state allowance payable to the accused party temporarily suspended from his or her duties be calculated from the subsistence minimum in general for the able-bodied population in the Russian Federation.  

5. Draft federal law On Social Guarantees for Staff of Certain Federal Executive Agencies and On Amending Some Legislative Acts of the Russian Federation

 The law stipulates social guarantees for the staff of institutions and agencies of the penitentiary system, bodies for monitoring trafficking in narcotic drugs or psychotropic substances, customs bodies, and federal fire-fighting units of the State Fire-Fighting Service.

In drafting the law, care was taken to ensure that the new regulations did not cancel social guarantees for staff or substantially lower previous provision levels.

Article 4 of the draft preserves the amounts stipulated for the staff of the Federal Drug Control Service as regards social security payments to acquire or to build living accommodations.

 Furthermore, staff – employees who have been placed on waiting lists for housing before March 1, 2005 – can be provided with living accommodation under a social lease contract on state housing stock or service housing given there is such a service housing stock. Certain categories of staff and the members of their families can be given living accommodation under property rights.

 Provision is made to supply staff members with travel documents for all kinds of city, commuter, and local public transport.

 

6. Draft federal law On Amending the Criminal Procedure Code of the Russian Federation (in the Section Concerning Criminal Proceedings in the Event of the Death of an Accused, a Suspect, or a Person Facing a Criminal Charge)

 In order to regulate criminal proceedings in the event of the death of the accused, a suspect or a person facing a criminal charge, the draft amends 10 articles of the Criminal Procedure Code, and also supplements the code with a new chapter containing 10 new articles of the code. An individual with a special status – “a representative of the accused” – will now take part in criminal proceedings. The accused may be represented by near relations or their legal representatives, by relations or their legal representatives, or by related people or their legal representatives involved in the statutory manner in criminal proceedings in the event of the death of the accused, a suspect, or a person facing a criminal charge.

 

7. Draft federal law On Amending Article 350 of the Labour Code of the Russian Federation (in the Section Concerning the Possibility for the Staff of Medical Institutions Located in Rural Areas to Perform Their Duties as On-Call Service)

The draft supplements Article 350 of the Labour Code with provisions allowing certain categories of medical staff at medical institutions to perform their duties from home.

 

8. Draft federal law On Amending Article 26 of the Federal Law On the Procedure for Exiting from or Entering into the Russian Federation

 The draft proposes a possible ban on foreign nationals entering the Russian Federation within three years of leaving the country, who during the period of their previous stay failed to depart upon the expiry of 30 days from the end of their temporary presence except in cases when it was impossible for them to abandon the territory of the Russian Federation due to the need for urgent medical treatment, owing to a grave disease or because of the death of a near-relation resident in Russia, as well as due to force majeure circumstances (extraordinary and unavoidable conditions in the given situation), or other natural causes. 

This ban will be enforced daily in an automatic mode and make it possible to timely prevent this category of foreign nationals from entering the country.

 

9. Draft federal law On the Ratification of the Agreement between the Government of the Russian Federation and the Eurasian Economic Commission on the Hosting of the Eurasian Economic Commission on the Territory of the Russian Federation

The Agreement between the Government of the Russian Federation and the Eurasian Economic Commission on the Hosting of the Commission on the Territory of the Russian Federation was signed in Moscow on June 8, 2012.

The signing of the agreement was necessitated by the need to implement the Treaty on the Euroasian Economic Commission of November 18, 2011, which founded the commission as a unified permanent regulatory agency of the Customs Union and the Common Economic Space.

The agreement’s goal is to create proper conditions for the commission’s activity and location on the territory of the Russian Federation.

 

10. Draft federal law On the Ratification of the Agreement on Transport Controls on the External Borders of the Customs Union

 In line with the federal law On International Treaties of the Russian Federation, the Agreement on Transport Controls on the External Borders of the Customs Union is subject to ratification.

The agreement sets the conditions for moving transport controls from the Russian-Belarusian and Russian-Kazakh frontiers to the external Customs Union borders, and also provides a legal foundation for information exchanges between the transport controlling authorities of the three countries.

 

11. Paying a 2012 voluntary contribution by the Russian Federation to the Inter-State Fund for Humanitarian Cooperation between Commonwealth of Independent States (CIS) Member-Countries

 The directive aims to secure financial support from the Russian Federation to the Inter-State Fund for Humanitarian Cooperation between CIS Member-Countries.

The draft provides for a voluntary contribution of 250 million roubles to the fund in 2012.

 

12. Introducing changes in the distribution of 2012 subsidies from the federal budget to the budgets of entities of the Russian Federation to co-fund their spending obligations on public welfare payments to young families to acquire housing as part of the Housing for Young Families sub-programme of the federal targeted programme Housing for 2011-2015, approved by Government Directive No 582-r of April 19, 2012

 With a view to implement the 2012 Housing for Young Families sub-programme of the Housing federal targeted programme from 2011 to 2015, the Government approved the distribution of this year’s subsidies totalling 4,965,110,000 roubles to co-fund the entities’ spending obligations on public welfare payments to young families to acquire housing as part of the sub-programme.

The budget allocations were distributed between 79 facilities selected as participants in the 2012 programme through a competitive selection conducted in the established procedure by the Ministry of Regional Development.

According to Paragraph 8 of the rules, a subsidy is granted to the budget of the entity concerned following an agreement concluded between the Ministry of Regional Development and the highest executive authority of the entity.

In the course of the conclusion of the agreements, 17 entities submitted regional legal acts that testified to the reduction of their previously declared spending obligations requiring a subsidy. According to Paragraph 13 of the rules, subsidies for such entities are due for reduction, and the released funds for redistribution. Any redistribution of the subsidies between the budgets is approved by the Government.

Furthermore, following the failure of the Republic of Ingushetia to fund its 2011 spending obligation from its regional budget, as provided for by the 2011 agreement, federal budget funds totalling 90,091,580 roubles and designated for Ingushetia in 2012 are also subject to redistribution.

The draft directive proposes increasing subsidies through the redistribution of 378,425,660 roubles in released funds to 17 entities that undertook additional spending obligations on social payments to young families to acquire housing.

 

13. Distributing 2012 federal budget subsidies to the budgets of the entities of the Russian Federation to co-fund their spending obligations on support measures for supporting the activities of f peasants (farmers)

 The draft directives were drawn up in accordance with the Rules for Granting and Distributing Federal Budget Subsidies to the Entity Budgets of the Russian Federation to Promote Family-Run Livestock Farms, as approved by Government  Resolution  No 165 of February 28, 2012, and the Rules for Granting and Distributing Federal Budget Subsidies to Entity Budgets of the Russian Federation to Support Beginner Farmers, as approved by Government Resolution No 166 of February 28, 2012.

         The drafts provide for the redistribution of 2012 federal budget subsidies allocated for:

  • the development of family-run livestock farms totalling 40,582,754 roubles and not used by the Republic of Altai, the Republic of Kalmykia, the Republic of Karelia, the Komi Republic, the Republic of Mari El, the Republic of North Ossetia-Alania, the Udmurtian Republic, the Stavropol Territory, Arkhangelsk, Astrakhan, Volgograd, Omsk, Orel, the Saratov and the Yaroslavl region and the Khanty-Mansi Autonomous Area-Yugra due to a lack of co-funding from the budgets of these entities.
  • support for beginner farmers totalling 13,911,430 roubles and not used by the Republic of Adygea, the Republic of Ingushetia, the Karachayevo-Circassian Republic, the Komi Republic, the Republic of Mari El, the Republic of North Ossetia-Alania, Volgograd, Magadan, Novgorod, Omsk, the Tula and the Chelyabinsk region and the Khanty-Mansi Autonomous Area due to the lack of co-funding from the budgets of these entities.

Funds for the development of family-run livestock farms are being additionally channelled to the Republic of Tuva (14,771,754 roubles), the Republic of Tatarstan (13,388,000 roubles), the Kostroma Region (2,506,000 roubles), and the Samara Region (9,917,000 roubles).

Funds for the support of beginner farmers are additionally channnelled to the Republic of Tuva (6,182,000 roubles) and the Samara Region (7,729,430 roubles).

 

14. Amending certain Government statutes regarding the technical inspection of transport vehicles

 The draft resolution provides for amending the Rules for the Technical Inspection of Transport Vehicles and the Rules for the Technical Inspection of Means of City Electric Surface Transport. The amendments highlight:

  • the introduction of a new party in the legal relationship covering the technical inspection of transport vehicles – a dealer for specific brands of vehicles allowed to inspect only those vehicles that are serviced by him;
  • the invalidation of the technical inspection sticker as a document confirming the technical inspection of the vehicle and the replacement of the sticker with a diagnostic card;
  • confirmation of some corrections to existing diagnostic cards, including those used for international purposes.

 

15. Acknowledging the invalidity of certain Government statutes as invalid

 The draft resolution acknowledges as invalid the Government Resolution On Approving the Procedure for Establishing and Using Extra-Budgetary Funds of Federal Executive Bodies and Profit Organisations to Fund Research and Development and On Amending and Acknowledging as Invalid Certain Government Statutes on the Taxation of Organisations’ Profits.

The draft also amends the Regulations for the Ministry of Education and Science in the section concerning cancelling the Ministry’s powers to keep a registry of branch-specific and inter-branch research and development funds.
