Decisions of the March 26, 2009 Government meeting
The Presidium of the Government at its meeting on March 26, 2009 adopted the following decisions on the items on its agenda:
1. Current issues
The Government has instructed the Ministry of Economic Development to review and summarise the proposals and criticisms made during the discussion of the draft government programme of anti-crisis measures for 2009 and consider the results in finalising the draft programme.
The Ministry of Economic Development and the federal executive bodies concerned have been instructed to accelerate the introduction of amendments to Russian legislation aimed at clarifying measures to prevent corporate raids.
2. Results of implementing the forecast plan (programme) of federal property privatisation for 2008 and the main trends in privatising federal property in 2010.
The meeting noted the report of the Federal Agency for State Property Management (Rosimushchestvo) on the above issue.
The Government of the Russian Federation has instructed:
- the Ministry of Economic Development and the federal executive bodies concerned:
- to create additional measures to meet the targets of federal property privatisation and submit the relevant proposals to the Government by April 15, 2009, in line with the established procedure;
- to prepare and duly submit to the Government proposals for enhancing the effectiveness of federal property privatisation by June 1, 2009, paying special attention to:
- reducing the time required to prepare federal property for privatisation with respect to the registration of ownership rights to federal property currently in economic management by federal state unitary enterprises;
- creating propitious conditions for the development of small and medium-sized businesses;
- cutting state property management costs;
- improving the legal framework by establishing simplified privatisation procedures for facilities to be contributed to the authorised capital of integrated companies, as well as facilities not privatised in the reporting year;
- using electronic trading in privatising federal property, and
- setting a fair price for privatisation facilities.
- The Ministry of Economic Development and the federal executive bodies concerned have been instructed to review the issue of introducing amendments to Russian legislation on placing orders for the provision of goods, works and services for state and municipal needs when there is a single supplier (contractor).
- The Ministry of Transport and the Ministry of Economic Development have been instructed to review the issues discussed on progress in privatising airports and their transfer into the ownership of the Federation members and to submit the relevant proposals to the Government. First Deputy Prime Minister Sergei Ivanov is to coordinate this work.
- The Ministry of Economic Development and the Ministry of Regional Development have been instructed to step up the drafting of regulatory acts on the delimitation of ownership rights between the Russian Federation, the regions and municipal entities and duly report the results to the Government.
- The Ministry of Economic Development and the Ministry of Justice have been instructed to further discuss the draft government resolution on material support for small and medium-sized businesses by leasing real assets to them and to duly report the results to the Government.
- The Ministry of Economic Development has been instructed to report to the Government the progress in implementing the forecast plan (programme) of federal property privatisation for 2009 on a quarterly basis before the 15th of the following month after each quarter.
3. Draft Federal Law On Introducing Amendments to the Federal Law On Additional Guarantees of Social Support for Orphaned Children and Children Left without Parental Care, specifying the mechanisms and the terms and conditions of providing social support for orphaned children and children left without parental care.
The Government has approved the above draft federal law and will submit it to the State Duma, the Russian Parliament's lower house, in line with established procedure.
4. Draft Federal Law On Introducing Amendments to Some Legislative Acts of the Russian Federation (regarding the introduction of a mechanism of close-out netting).
The Government has approved the above draft federal law and will submit it to the State Duma, the Russian Parliament's lower house, in line with established procedure.
5. Draft Federal Law On Introducing Amendments to Articles 69 and 119 of the Customs Code of the Russian Federation.
The Government has approved the above draft federal law and will submit it to the State Duma, the Russian Parliament's lower house, in line with established procedure.
The Federal Customs Service and the Ministry of Industry and Trade have been instructed to examine the issue discussed during the meeting of prolonging the period of customs duty payment through the use of the mechanism of guarantees for participants in foreign trade activities and to submit the relevant proposals to the Government within two weeks in line with the established procedure. First Deputy Prime Minister Viktor Zubkov is to coordinate this work.
6. Draft Federal Law On Ratification of the Agreement between the Government of the Russian Federation and the Government of the Republic of Indonesia on the Encouragement and Protection of Capital Investment.
The Government has approved the above draft federal law and will submit it to the State Duma, the Russian Parliament's lower house, in line with established procedure.
7. Draft Federal Law On Introducing Amendments to Some Legislative Acts of the Russian Federation on the Compensation of Legal Costs.
The Government has approved the above draft federal law and will submit it to the State Duma, the Russian Parliament's lower house, in line with established procedure.
8. On Submitting the Convention on the Transfer of Convicts from Court to the Penitentiary Service to the President of the Russian Federation for approval for ratification.
The Government of the Russian Federation has adopted the Government resolution on the above issue.
9. On Submitting the Treaty between the Russian Federation and the Republic of Angola on Mutual Legal Assistance on Criminal Cases to the President of the Russian Federation for approval for ratification.
The Government of the Russian Federation has adopted a draft Government resolution on the above issue.
10. On Submitting the Protocol on Introducing Amendments to the Agreement between the Russian Federation and the Republic of Kyrgyzstan dated October 21, 1994, on the terms of leasing locations for station units of the Seismic Service of the Russian Defence Ministry in the Republic of Kyrgyzstan to the President of the Russian Federation for approval for ratification.
The Government of the Russian Federation has adopted a draft resolution on the above issue.
