The draft federal law On Introducing Amendments to Article 7 of the Federal Law On State Regulation of Aviation Development and Article 8 of the federal law On Licensing Certain Types of Activity was submitted by State Duma Deputy Oleg Savchenko.
The Government of the Russian Federation has examined this draft law.
The draft law proposes amending Article 7 of Federal Law No 10-FZ On State Regulation of Aviation Development of January 8, 1998 and Article 8 of Federal Law No 99-FZ of May 4, 2011On Licensing Certain Types of Activity, hereinafter referred to as Law No 99-FZ, as regards the stipulation of license requirements on compliance with regulatory, technical, operation-and-maintenance requirements, as well as specific terms for the development, manufacture, testing, repairs and maintenance of aircraft being stipulated by federal executive agencies, which ensure regulatory oversight in this area of activity.
Article 8 of Law No 99-FZ expressly states that the relevant list of license requirements being approved by a Government resolution is formulated on the basis of specific requirements as regards the establishment of legal entities and their activity, the activity of self-employed business persons in the relevant areas of activity being stipulated by federal laws and other regulatory acts of the Russian Federation being approved under these laws.
Furthermore, current aviation legislation does not stipulate the concept “requirements as regards compliance with regulatory, technical, operation-and-maintenance requirements, as well as specific terms for the development, manufacture, testing, repairs and maintenance of aircraft,” being stipulated by federal executive agencies, which ensure regulatory oversight in this area of activity.
Specific license requirements with regard to prospective license holders/licensees can be expanded by amending the Regulations On Licensing the Development, Manufacture, Testing, Repairs and Maintenance of Aircraft, which was approved by Government Resolution No 240 of March 28, 2012.
Consequently, the relevant issues, which the draft law aims to resolve, have already been resolved by current legislation.
