The following decisions were approved after the June 26 meeting on transferring the immovable property of the Defence Ministry's unused military towns to the ownership of constituent entities of the Russian Federation and to municipal ownership, and on preparing the transferred facilities for the 2012-2013 autumn and winter heating season.
1. To take under advisement the reports by the Defence Ministry (Anatoly Serdyukov) and the Ministry of Regional Development (Oleg Govorun) on the process of transferring the immovable property of the Defence Ministry's unused military towns to the ownership of constituent entities of the Russian Federation and to municipal ownership, and on preparing the transferred facilities for the 2012-2013 autumn and winter heating season.
2. The Ministry of Defence (Anatoly Serdyukov) shall submit a report within a week explaining the non-execution of the Government instructions of May 30, 2012 No. DK-P4-83pr (Para. 3) and of June 19, 2012 No. DK-P4-94pr (Para. 3) on approving a methodology for calculating the amount of funds to be redistributed to the budgets of constituent entities of the Russian Federation for the upkeep of facilities transferred by the Defence Ministry to the ownership of constituent entities of the Russian Federation and to municipal ownership, and on punishments for those responsible for said non-execution.
3. The Ministry of Defence (Anatoly Serdyukov) shall, within five days and following coordination with the Ministry of Finance, approve a methodology for calculating the amount of funds due to be redistributed to the budgets of constituent entities of the Russian Federation for the upkeep of facilities transferred by the Defence Ministry of Russia to the ownership of constituent entities of the Russian Federation and to municipal ownership. Copies of the approved methodology shall be submitted to the Government of the Russian Federation;
Dwellings, utility infrastructure, and social and communal facilities of the Armed Forces of the Russian Federation, which are administered and disposed by the Ministry of Defence, shall be transferred to the ownership of constituent entities of the Russian Federation and to municipal ownership in a state fit for use, with funds for their regular upkeep, and in strict conformity with the provisions of Presidential Executive Order No.604 of May 7, 2012, On the Further Improvement of Military Service in the Russian Federation, and Federal Law No.423-FZ of December 8, 2011, On the Procedure for the Free Transfer of Military Immovable Property to the Ownership of Constituent Entities of the Russian Federation – the Federal Cities of Moscow and St. Petersburg, to Municipal Ownership, and on Introducing Amendments to Certain Legislative Acts of the Russian Federation;
Working groups shall be formed following coordination with the heads of constituent entities of the Russian Federation to draw up detailed lists of the military towns' immovable property not used by the Ministry of Defence, including plots of land, and integrated schedules for its transfer. Copies of joint resolutions establishing the working groups and endorsing their membership shall be submitted to the Government of the Russian Federation by August 1, 2012;
The Defence Ministry's order with regard to resolutions on transferring immovable properties to the ownership of constituent entities of the Russian Federation and to municipal ownership shall indicate the amount of funds to be redistributed to the budgets of constituent entities of the Russian Federation and the size of the plots of land transferred along with facilities, which in turn has been coordinated with the recipient, as well as data on the lack of debts for housing and utilities services and other services (works) related to the transferred immovable properties;
Information on preparing housing and utilities facilities for the autumn and winter season (in accordance with a form established for constituent entities of the Russian Federation), on transferring facilities to the ownership of constituent entities of the Russian Federation and municipal ownership, and on repaying overdue debts for housing and utilities services shall be sent to the Ministry of Regional Development monthly by the 10th day of the month following the reporting month;
Results of constituent entities of the Russian Federation and municipal entities accepting and operating the transferred facilities shall be reported to the Government of the Russian Federation before November 1, 2012.
4. Power-supply, power-engineering and housing and utilities facilities transferred by the Ministry of Defence to the ownership of constituent entities of the Russian Federation and to municipal ownership after July 1 shall only be transferred to recipients after being certified fit for operation during the forthcoming autumn and winter period and after receiving operation permits.
5. The Ministry of Defence (Anatoly Serdyukov) and the Federal Service for Environmental, Technological and Nuclear Supervision (Nikolai Kutin) shall transfer and assume oversight functions with regard to hazardous production facilities and power-supply, power-engineering and housing and utilities facilities transferred to the ownership of constituent entities of the Russian Federation and to municipal ownership.
6. The Ministry of Regional Development (Oleg Govorun), jointly with the Federal Tariff Service, the Ministry of Defence, and following coordination with the executive authorities of constituent entities of the Russian Federation, shall submit to the Government of the Russian Federation proposals (with appropriate draft laws, if necessary) on minimising the effect of inter-tariff differences on the amount of housing and utilities payments in the military towns subject to transfer.
7. Executive authorities in constituent entities of the Russian Federation jointly with the Ministry of Defence shall ensure the uninterrupted operation of power-supply, power-engineering and housing and utilities facilities transferred to the ownership of constituent entities of the Russian Federation and to municipal ownership.
