Official Government review of the draft law On Introducing Amendments to the Federal Law On the Industrial Safety of Hazardous Production Facilities and to Article 48.1 of the Urban Planning Code of the Russian Federation

 
 
 

The draft federal law On Introducing Amendments to the Federal Law On the Industrial Safety of Hazardous Production Facilities and to Article 481 of the Urban Planning Code of the Russian Federation has been introduced by the Kostroma Regional Duma.

The Government of the Russian Federation has considered the draft federal law.

The draft law proposes introducing amendments to Supplement 1 to the Federal Law On the Industrial Safety of Hazardous Production Facilities and to Article 481 of the Urban Planning Code of the Russian Federation, concerning the elimination of open-cut mining at deposits of common commercial minerals with no capital structures, as well as the drilling of appraisal and exploratory wells during geological prospecting, exploration and production of common commercial minerals, from the lists of hazardous production facilities or highly hazardous and technologically complex facilities.

The need to exclude redundant safety requirements envisioned by Russian Federation laws is supported.

At the same time, in order to upgrade the industrial safety legislation, it seems more expedient to use a comprehensive approach specifying all identification and categorisation criteria with regard to hazardous production facilities and to envision differentiation of regulatory measures applied thereto.

The law currently in force is the Federal Law On Introducing Amendments to the Federal Law On the Industrial Safety of Hazardous Production Facilities, Separate Laws of the Russian Federation and On Repealing Subparagraph 114 of Paragraph 1 of Article 33333 of Part Two of the Tax Code of the Russian Federation, which is aimed at a systematic improvement of the industrial safety legislation, including the division of the hazardous production facilities into four hazard classes in keeping with the established criteria. Specifically, all facilities engaged in the flash-free production of common commercial minerals have been excluded from the category of hazardous production facilities.
