Decisions resulting from the meeting on the state of road safety and measures to prevent road traffic accidents involving drivers under the influence of alcohol

 
 
 

The following decisions were taken at the meeting on October 5, 2012 on road safety and measures to prevent road traffic accidents involving drivers under the influence of alcohol:

1.To take note of the report by Deputy Minister of Internal Affairs Viktor Kiryanov and contributions of participants of the meeting on this issue.

To note the need to introduce amendments to the legislation of the Russian Federation that would impose tougher punishments for road safety violations.

2.The Ministry of Internal Affairs (Vladimir Kolokoltsev), the Justice Ministry (Alexander Konovalov) and the Transport Ministry (Maxim Sokolov), jointly with the federal executive bodies and organisations concerned, shall by November 1, 2012 submit proposals on introducing amendments to the criminal and administrative legislation of the Russian Federation, including:

punishing drunk driving by a substantial fine with a simultaneous driving ban for a longer period than is currently envisaged;

to criminalise driving while under the influence of alcohol for repeat offences, envisaging a substantial fine and simultaneous driving ban for a period stipulated under the law;

toughening criminal liability for driving under the influence of alcohol if this act caused serious injury to or the death of one, two or more persons, by setting a minimum term of imprisonment and increasing the maximum term of imprisonment;

toughening administrative liability of drivers for exceeding the speed limit, jumping red lights, driving on the wrong side of the road and other dangerous road safety violations;

prepare proposals on changing the period during which a person is under administrative punishment for violations committed while driving under the influence of alcohol, envisaging criminal liability for repeated violations of the above type;

introduce differentiated liability for very dangerous violations of road safety rules with due account of regional specifics.

First Deputy Prime Minister Igor Shuvalov shall consider the above proposals.

3.The Ministry of Internal Affairs (Vladimir Kolokoltsev), jointly with the federal executive bodies concerned, shall:

submit to the Government according to standard procedure a draft Government resolution that would introduce amendments to the Traffic Rules approved by Government Resolution No. 1090 of October 23, 1993 On Traffic Rules to drop the requirement for drivers to carry and submit at the request of the police for inspection a document confirming their right to drive the vehicle in the absence of its owner.

Deadline: October 20, 2012;

submit to the Government proposals on monitoring the roadworthiness of vehicles with an engine capacity of less than 50 cubic centimetres or maximum electric motor power of less than 4 kilowatts as well as the permission of drivers to use the above transport means.

Deadline: October 20, 2012.

4.The Ministry of Internal Affairs (Vladimir Kolokoltsev) and the Justice Ministry (Alexander Konovalov), jointly with the Prosecutor General’s Office, shall develop a set of measures aimed at preventing and stopping abuses and corruption-related offences on the part of traffic police in the process of conducting supervisory and control activities.

5.The Ministry of Finance (Anton Siluanov), jointly with the organisations concerned, shall supervise the preparation and submission to the Government of the draft federal law On Introducing Amendments to the Law of the Russian Federation On Organising Insurance in the Russian Federation and the federal law On Mandatory Civil Liability Insurance for Owners of Vehicles, which regulate the procedure of the payment of insurance without statements being prepared by traffic police officials.

Deadline: October 2012.

6.The Ministry of Justice (Alexander Konovalov) and the Ministry of Internal Affairs (Vladimir Kolokoltsev), jointly with the federal executive bodies concerned, shall prepare proposals on:

introducing a mechanism for the temporary seizure of vehicles as collateral to secure compliance with the resolution of administrative offences involving driving under the influence of alcohol as well as barring citizens who have not paid an administrative fine from executing any legal activities;

improving the procedure of compensating damages to victims of road traffic accidents in which harm has been caused to the victim’s health.

Deadline: November 1, 2012.

7.The Ministry of Education and Science (Dmitry Livanov)

shall submit proposals on training driving instructors;

study the issue of introducing amendments to license requirements and terms concerning the activities of training drivers.

Deadline: November 2012.

8.The Ministry of Transport (Maxim Sokolov) shall develop rules for transporting organised groups of children as well as rules for carrying passengers and cargo by road.

9.The Transport Ministry (Maxim Sokolov) and the Ministry of Internal Affairs (Vladimir Kolokoltsev), jointly with the federal executive bodies concerned, shall create a working group to prepare proposals on improving road markings.

The results shall be reported to the Government by December 1, 2012.

10.The Ministry of Healthcare (Veronika Skvortsova) shall ensure the introduction to the legislation of the Russian Federation of medical support for road safety measures, envisaging the requirement for mandatory medical checkups of drivers at least once every five years.
